Aubin v. MAG Realty, LLC, 161 A.3d 1143, 1146 (RI 2017).
In this case, our client slipped and fell in a puddle of water at a store. Throughout the course of Mike’s investigation, he discovered that the store manager was aware of the specific issue of water leaking through the ceiling after rain storms. We contended that the store had a duty to warn our client against the potential danger of the slippery condition.
The case was hotly contested and no liability admitted. We went to work through investigation and discovery to satisfy our burden of proof. Mike worked with experts and medical providers to link the injuries to the slip and fall personal injury. Ultimately, the case settled through an alternative dispute resolution called mediation.
During the mediation process, Mike obtained a settlement for $650,000.00. Our client has been compensated for her lost wages, medical expenses, and ongoing personal injuries.
