The prestigious New England Journal of Medicine recently published a comprehensive study of medical malpractice claims that had some interesting findings. The study supported what our national and state lawyer groups have been stating for many years: only very strong cases with high expected payouts are pursued. The co-author, Amitabh Chandra, an economist and professor of public policy at the Harvard Kennedy School of Government stated, “A lawyer would have to be an idiot to take a frivolous case to court.” According to the Institute of Medicine, 98,000 people die every year from medical malpractice, making medical malpractice the 6th leading cause of death in this country.
