Now that warm weather is here in our Rhode Island and Southeastern Massachusetts communities, it is no surprise that people are increasingly using bicycles, scooters, skateboards, etc. to get around town. And we love that our communities are so active! However, as an electric bike injury attorney, our firm sees firsthand the dangers of riding alongside motor vehicles.
In today’s case highlight, we review how we helped a recently injured e-bike rider client get the compensation he deserved after his accident!
Motor Vehicle Hits Electric Bike Rider Causing Multiple Pelvis Fractures
Our client uses an electric bike for transportation and enjoyment. However, his recent accident changed his perception of riding forever.
One otherwise unremarkable evening, our client was riding his electric bike in the bike lane down South Country Trail in South Kingstown, Rhode Island. As a seasoned rider, our client kept lamps on the front and rear of his e-bike for safety purposes. In short, our client was obeying all traffic laws and making his presence known to others on the road.
But accidents happen, even to the safest riders. In this case, the at-fault driver was turning out of the South Kingstown Nursing and Rehabilitation parking lot. As they were pulling out to turn left on South County Trail, they failed to make sure it was safe to do so and struck our client, who was traveling between 20 and 25 MPH!
Due to the impact, our client went up and over the at-fault driver’s car hood and ultimately landed on the pavement. Once the South Kingston Fire Department arrived, they transported our client to South County Hospital for his hip pain.
E-Bike Accident Results in Multi-Day Hospital and Rehabilitation Stays
Once our client arrived as South County Hospital, he did not leave for three days. While at the hospital, doctors diagnosed our client with multiple pelvic fractures. After his initial care, our client returned to the hospital because he was in severe pain and unable to care for himself. From there, he was referred to and admitted to a physical therapy treatment facility.
This was not the only treatment he required. Our client returned to the ER and was ultimately admitted for four days for more physical therapy sessions. He also visited Ortho Rhode Island for multiple physical therapy sessions thereafter.
Needless to say, our client went through a lot after his e-bike accident. On top of the pain our client endured, he needed continued dialysis treatments. His multiple pelvis fractures made it extremely difficult to transport himself to and endure his dialysis treatments.
How Can an Electric Bike Injury Attorney Help Me?
As this case highlight illustrates, tragedy can strike even when you are taking all safety precautions necessary while riding and e-bike. We at Bottaro Injury Lawyers have repeatedly helped our Rhode Island and Southeastern Massachusetts clients when they’ve found themselves in similar situations.
As personal injury professionals, we help our clients:
- Weigh their legal options after an accident, as governed by state law and insurance policy language.
- Determine fault and swiftly begin the negotiation process with the correct party or entity.
- Analyze all case documents to determine fault, build your case, and negotiate your case for its maximum worth.
- Answer any and all questions you have along the way, as well as comply with any requests and deadlines associated with the claims process.
- Prepare to file a lawsuit in the correct court of law, should the claims negotiation process not result in a proper settlement.
In this case, we were able to negotiate a $120,000.00 settlement for our injured e-bike client. This amount covered his medical expenses, along with the pain and suffering he endured. Questions about how we can help you in your personal injury case? Contact us at any time!
