Loose and Broken Wooden Planks Cause Newport, RI Trip and Fall Resulting in Major Arm and Shoulder Fractures

Our 74-year-old client was enjoying a nice, sunny day with her family in Newport, RI. From Philadelphia, our client’s visit to RI with her family was a special vacation time for everyone.

However, around 1:00pm, while walking on a public walkway around 25 Waites Wharf, our client suddenly tripped forward on a broken wooden plank.  This caused her to fall forward and immediately sustain injuries to her nose, face, knee, and right shoulder.

This trip and fall caused our client severe and immediate pain. She cried out in pain and for help.

The Newport Fire Department quickly arrived at the scene.  Emergency personnel noted that in addition to our client’s right arm pain, the shoulder itself looked deformed and that our client was dizzy and sweaty. As a result, emergency personnel transported her to Newport Hospital.

At the hospital, doctors also noticed her shoulder deformity and nose and lip abrasions. After reviewing our client’s X-rays, doctors confirmed that she had severely fractured her right arm and shoulder. They referred her to an orthopedic doctor and put her arm in a sling.

Four days later, when our client returned home to Philadelphia, doctors confirmed her right arm fractures and referred her to surgery.

Our client’s surgery scar. This scar will likely remain visible for our client’s entire life.

Life after the surgery was tough for our client. In recovery, she experienced an intolerance to medications and needed physical therapy to address her continued arm and shoulder pain.

How Do I Know if I Need and Out-of-State Attorney and What Can One Do for Me?

Generally, if you sustain personal injuries in a state other than your home state, you should contact a personal injury law firm from the state the accident occurred in.

For example, while our client received the majority of her treatment, including surgery, doctor’s visits, and physical therapy sessions, in Philadelphia, the negligence itself occurred in Newport, RI. Our client did the right thing by reaching out to us to assist.

We built our client’s case while she focused all her attention on healing. Our investigators noticed that the property management company had previously made fixes and improvements to the wooden plank walkway our client tripped and fell on. Why does this matter? It produced strong evidence that the management company was on notice that the walkway posed a dangerous condition. Meaning the company was a fault for failing to make the walkway safe for the public.

With this, and other pieces of evidence and application of the law, we were able to secure a $350,000.00 settlement for our client. Our client still feels pain in her right arm and shoulder, but we were happy to do our part to make her life moving forward a little easier.
