What is Mediation, and How Can It Help to Win a Case?

In several personal injury cases, we go to mediation, and clients often have many questions about what it is and how it fits into the case: What is mediation, what actually happens there and how do you prepare for it?

Mediation is a settlement negotiation where an impartial lawyer or judge will help to settle a case. We meet with this impartial party to hear the opposing side’s argument and present our side while trying to prove the other party is indeed at fault.

To be successful at mediation, preparation is key. We need to understand causation and damages. In total, we need to analyze all of the factors of your case. An effective strategy is then to also present a comprehensive written case to the mediator, prior to meeting with them.
